White Plains To Seek Appeal In Russo-Carriero Wrongful Death Verdict

WHITE PLAINS, N.Y. -- The City of White Plains said Monday that it will be seeking an appeal after a jury found the city negligent in the 2005 stabbing death of Concetta "Connie" Russo Carriero.

According to John Callahan, corporation counsel of the City of White Plains, the city already has an appeal pending regarding the Court’s failure to dismiss the case prior to trial, which it will continue to pursue.

"There is a pending appeal that was filed before the trial even began," Callahan said in a statement. "We're appealing because we believe the City has immunity from this type of suit. We will also probably be filing an appeal on the verdict, and we will be filing an appeal on a number of errors that were committed during the trial."

The jury concluded on Monday that negligence by the city of White Plains was a significant factor in the death of Russo-Carriero, who was stabbed to death in a parking garage near the Galleria in 2005 by Phillip Grant.

The jury awarded her family approximately $2 million in damages. 

"The death of Concetta Russo Carriero in 2005 was a tragic event brought about by a deranged individual," the statement said.

"White Plains is a safe city but, as we know, even in the safest of places horrible random acts of violence can occur."
